Each order placed with us, Fine Vintage (Far East) Ltd., via our website, www.grapengrain.com, will be governed by the following Terms and Conditions.

Purpose and integration of the general Terms and Conditions of sale (T&C)

These Terms and Conditions apply to all contracts executed between Fine Vintage (Far East) Ltd. (hereinafter referred to as “FV”) and any individual or legal entity (hereinafter the “Customer”) (hereinafter collectively the “Parties”) relating to the ordering and purchase of goods from FV by the Customer, whether these contracts are concluded via email, by telephone or by any other communication means. The Customer confirms reading these T&Cs before any transaction with FV and agrees to them fully.

Execution of contract

A sales contract is deemed to be executed between the Parties as soon as FV confirms the Customer’s order to the latter, in writing, electronically, or by any other means, whether expressly or implicitly. FV reserves the right to decline an order and to accept it only partially without giving any reason. In such cases, FV duly informs the Customer.

E-store account and Registration

• To place an order on our e-store, you need to register as a user.
• When you register, make sure to provide accurate, complete, and up-to-date information.
• Keep your username and password safe, and don't share them with anyone else.
• Your username and password are considered your authorization for placing orders.
• Note that we have the right to refuse registration or terminate a customer's registration at our discretion.
• If your information changes, please let us know through our website, email, or phone so we can communicate with you effectively.
• When placing an order, you confirm that you are 18 years or older, as it is illegal to sell alcohol to anyone under 18.

E-store Sales

After receiving your order, we will send you an email confirmation. Please note that this confirmation does not indicate acceptance of your order or constitute order acceptance. It simply confirms that we have received your order.

All orders are subject to confirmation of final availability. We reserve the right to reject the order if any products or services requested are unavailable.

At FV's e-store, we do our best to ensure all products displayed on our website are in stock. However, if a product becomes out of stock, we reserve the right to offer a similar alternative of equal value and style.

FV will not be held responsible for any direct or indirect loss, including loss of revenue, loss of profits, or any consequential loss incurred by you or any other person due to the sale and purchase transaction with you.

Prices

We understand that the prices displayed on our website are important to you, especially when you place an order. Please know that we always strive to ensure our prices are accurate, but sometimes mistakes can happen. If we discover that a product is mispriced and the correct price is higher than we stated, we will handle the situation carefully. We may contact you for further instructions before delivering your order, or we may cancel your order and notify you promptly. We appreciate your understanding and cooperation in these rare situations.

It is important to note that we hold the right to modify prices and delivery fees displayed on this website without prior notice.

Promotions

Offers are non-cumulative and cannot be used in conjunction with other promotions, discounts, and any promotion codes (unless otherwise specified).

To apply a promo code, you must enter it before completing your order. A promo code cannot be applied to previously placed orders. Promo codes that offer a percent off may not be used with other discounts or promotions.

Promo codes are not transferable or redeemable for cash or credit.

We have the right to cancel your order if any offer is used in conjunction with another.

Payment and retention of title

FV only accepts payment in Hong Kong dollars, and through specific payment methods such as designated credit cards, debit cards, or other electronic means, we may specify periodically.

FV reserves the right to restrict the customer’s choice of payment means without giving reasons.

The payment is due upon receipt of the invoice.

Title transfer in all goods shall pass to the Customer when full payment is made and FV confirms receipt.

Warranty

FV guarantees the authenticity of the goods sold, i.e., that the bottles sold contain the wine or spirit indicated on the label affixed to the bottle.

Control of the goods by the Customer

The Customer is obliged to check the state of the goods ordered as soon as they are received and to immediately notify FV of any defects falling under the warranty provided for in Art. 5 of these T & C. In the absence of such notice, the goods shall be deemed to be accepted by the Customer.

Limitation of Liability

The products showcased on this website are accompanied by photographs and texts that are not contractual and serve only as informational aids. We disclaim any responsibility in the event of any errors or omissions in the photographs or texts presented on this website.

FV obligation to compensate you under these Terms and Conditions is limited to the lower amount we have invoiced you or the amount you paid for the products you ordered.

FV shall not be liable for any consequential, punitive, incidental, indirect, or exemplary losses.

FV shall not be held liable for failing to perform our obligations under these Terms and Conditions due to circumstances beyond our control, including internet system failure, computer glitches, and hacking.

Applicable law and jurisdiction

The laws of Hong Kong SAR govern all sales and contracts.

Amendment to the T&C

FV can modify the present Terms and Conditions at any time by publishing a new version on our website. You agree to be bound by that updated version if you place an order after we have posted it.
